Terms & Conditions

These terms form the agreement between your business and AppMind Ltd for use of the Mizz AI platform. Please read them carefully — by creating an account you accept them.

1. Who we are

Mizz AI is a trading name of AppMind Ltd, a company registered in England and Wales (company number 16461561), ("we", "us", "our"). References to "Mizz AI", "the platform" or "the service" mean the software and services we provide at mizzai.com and its subdomains.

2. These terms and your agreement with us

By creating an account, ticking the acceptance box, or using the service, you confirm that you accept these terms and that you have authority to bind the business you are registering ("you", "your business"). If you do not accept these terms, do not use the service.

The service is provided for business use only. You must be at least 18 years old and acting in the course of a business, trade or profession. Because this is a business-to-business contract, certain consumer protections (including statutory cooling-off rights) do not apply.

3. The service

Depending on your plan, Mizz AI provides some or all of the following:

  • An AI assistant (chatbot) trained on the business information you supply;
  • A hosted landing page website at a Mizz AI address, and on the Pro plan the option to connect a domain you own;
  • Appointment booking, table reservations and order-taking features;
  • A dashboard for managing your content, bookings and subscription;
  • Optional payment collection from your own customers via Stripe.

We may improve, change or withdraw individual features. Where a change materially reduces the service, we will give you reasonable notice and you may cancel as set out in clause 6.

4. Your account

You must provide accurate registration details and keep them up to date. You are responsible for keeping your login credentials confidential and for all activity carried out under your account. Tell us promptly at support@mizzai.com if you believe your account has been accessed without authorisation.

5. Free trial

New businesses receive a free trial for the period stated at sign-up. No payment card is required to start the trial. At the end of the trial your assistant and website stop serving customers unless you take out a paid subscription. We may withdraw or vary trials, and may refuse a trial where we reasonably believe the same business has already had one.

6. Subscriptions, fees and cancellation

  • Plans and prices. Fees are those shown on our pricing page when you subscribe. Prices are stated in pounds sterling and, unless stated otherwise, are inclusive of any VAT that applies.
  • Billing. Subscriptions are billed in advance on a recurring monthly or annual basis and renew automatically until cancelled. Payments are taken by our payment processor, Stripe.
  • Cancellation. You may cancel at any time from your dashboard. Cancellation takes effect at the end of your current billing period; your service continues until then.
  • Refunds. Fees already paid are non-refundable except where required by law or where we have materially failed to provide the service. The free trial exists so you can evaluate the platform before paying.
  • Price changes. We may change our prices. We will give you at least 30 days' notice before a change affects your renewal, and you may cancel before it takes effect.
  • Failed payments. If a payment fails we may retry it and may suspend the service until payment succeeds.

7. Fair usage

Plans are intended for the normal customer-facing activity of a single business and are subject to fair usage. The vast majority of businesses are unaffected. We may apply reasonable limits to, or contact you about, automated, abusive or excessive use — for example traffic that is not from genuine customers (bots, scripted or bulk messaging), or volumes far beyond what is typical for a business of your size. Where possible we will notify you before taking any action.

8. Acceptable use

You must not use the service to:

  • Break any law, or infringe anyone's rights (including intellectual property or privacy rights);
  • Publish content that is unlawful, misleading, defamatory, obscene, discriminatory or harmful;
  • Advertise goods or services you are not lawfully entitled to sell, or make claims you cannot substantiate;
  • Upload malware, attempt to gain unauthorised access to the platform, or interfere with its operation or security;
  • Scrape, resell, sub-licence or white-label the service without our written agreement;
  • Impersonate another business, or use a business name, brand or domain you have no right to use;
  • Use the service for the bulk sending of unsolicited messages.

You are responsible for all content and business information you provide, and for ensuring it is accurate, lawful and kept up to date — including prices, availability, allergen and safety information, and any regulated or professional claims.

9. AI-generated responses — important

The assistant generates answers automatically using artificial intelligence and information you supply. AI systems can produce responses that are inaccurate, incomplete or unintended, including occasionally about prices, availability or policies.

  • You are responsible for reviewing your content and for monitoring how your assistant represents your business;
  • You should not use the service as the sole channel for safety-critical, medical, legal, financial or other regulated advice;
  • As between you and us, you are responsible to your own customers for the accuracy of information published through your assistant and website.

10. Bookings, orders and payments between you and your customers

Where your customers book appointments, reserve tables or place orders through Mizz AI, that contract is between you and your customer. We are not a party to it, and we are not the seller, agent or provider of your goods or services. You are responsible for honouring bookings and orders, for your cancellation, refund, delivery and returns policies, and for complying with consumer law.

If you enable payment collection, payments are processed by Stripe under your own Stripe agreement. Stripe holds the merchant relationship and is responsible for payouts, chargebacks and related compliance. We do not hold your customers' funds.

11. Custom domains

On eligible plans you may connect a domain you own. You confirm you have the right to use that domain. Connecting it requires you to change your domain's nameservers, which moves DNS management for that domain to infrastructure we operate through Cloudflare — this can affect other services on the same domain, such as email, if their records are not carried across. You remain the owner of the domain and its registration, and you are responsible for renewing it. If your subscription ends, the domain stops serving your Mizz AI site.

12. Intellectual property

The platform, its software, design, and all materials we provide remain our property or that of our licensors. You are granted a non-exclusive, non-transferable licence to use the service for your business for as long as your subscription is active.

You keep ownership of your content — your business information, text, images and logos. You grant us a licence to host, reproduce, adapt and display that content only as needed to operate and promote the service to your customers. If you supply someone else's content, you confirm you have permission to do so.

13. Data protection

How we handle personal data is set out in our Privacy Policy, which forms part of these terms.

In respect of your own customers' personal data processed through the platform, you are the data controller and we act as your data processor. We will process that data only on your documented instructions (using the platform constitutes such instructions), keep it confidential, apply appropriate security measures, assist you with data-subject requests so far as reasonably practicable, and delete or return it on termination as described in the Privacy Policy. You are responsible for having a lawful basis for collecting it and for giving your customers the notices the law requires.

14. Availability and support

We aim to keep the service available at all times but do not guarantee uninterrupted or error-free operation. The service may be unavailable during maintenance, or because of failures in third-party infrastructure we rely on. We provide support by email at support@mizzai.com.

15. Third-party services

The platform depends on third-party providers including Google Cloud and Google's AI models, Stripe, Amazon Web Services and Cloudflare. Their availability and terms are outside our control. We are not liable for failures caused solely by a third-party provider, though we will take reasonable steps to restore the service.

16. Suspension and termination

We may suspend or terminate your account, on notice where practicable, if:

  • You materially breach these terms, including the acceptable use and fair usage clauses;
  • Payment is overdue;
  • We are required to do so by law, or to protect the platform, its users or the public.

You may terminate at any time by cancelling your subscription and closing your account. On termination your right to use the service ends, your assistant and website stop serving customers, and we will handle your data as described in the Privacy Policy. Clauses that by their nature should survive termination (including 12, 17, 18 and 22) continue to apply.

17. Warranties and disclaimers

Except as expressly stated in these terms, and to the fullest extent permitted by law, the service is provided "as is" and "as available" and we exclude all implied warranties, conditions and other terms. We do not warrant that the service will meet your specific requirements, generate any particular level of enquiries, bookings or revenue, or that AI-generated content will be accurate.

18. Limitation of liability

Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be limited or excluded.

Subject to that:

  • We are not liable for loss of profit, loss of business, loss of goodwill, loss of anticipated savings, loss or corruption of data, or any indirect or consequential loss;
  • We are not liable for losses arising from your own content, from the acts or omissions of your customers, or from your failure to honour bookings or orders;
  • Our total liability arising in connection with the service in any 12-month period is limited to the total subscription fees you paid to us in the 12 months immediately before the event giving rise to the claim.

19. Your indemnity

You will indemnify us against claims, losses and reasonable costs arising from your content, your goods or services, your breach of these terms, or your infringement of a third party's rights.

20. Changes to these terms

We may update these terms from time to time. For material changes we will give reasonable notice by email or in your dashboard before they take effect. Continuing to use the service after that constitutes acceptance. If you do not accept a change, you may cancel.

21. General

  • Force majeure. Neither party is liable for failure caused by events beyond its reasonable control.
  • Assignment. You may not transfer your rights under these terms without our consent. We may assign our rights on notice, for example as part of a business reorganisation.
  • Third parties. No one other than you and us has any right to enforce these terms.
  • Severability. If any provision is found unenforceable, the rest remains in force.
  • Waiver. A delay in enforcing these terms is not a waiver of our rights.
  • Entire agreement. These terms and the Privacy Policy form the whole agreement between us regarding the service.

22. Governing law and jurisdiction

These terms and any dispute arising from them are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction.

Questions or complaints about these terms or the service should be sent to support@mizzai.com. We aim to acknowledge complaints within five working days.
